Probate

When you find yourself with a loved one who has just died, that person's estate must be administered in probate court. The court legally recognizes the death and appoints an administrator, usually the executor of the will. If there is no will someone will be appointed by the court.

The administrator will oversee the property and have the right to sign documents, sell property, and distribute assets on behalf of the estate. This process can be further complicated if the deceased left no will, or had complicated finances. If you are an heir, Jill M. When the estate is less than $50,000, can all be transferred by title, or by named beneficiary, probate may not be necessary. We can provide you with a small estate affidavit. Likewise if the only asset is the deceased's home, probate may not be necessary even if the value of the home is over $50,000. But in this event, you should still consult with our office because this situation can be tricky.
