Probate
- Do I need to open probate?
- Not every estate needs to open probate. If the estate is $50,000.00 or less, you may only need to get a small estate affidavit which can be obtained from Jill M. Metz & Associates at a fraction of the cost of opening probate.
- If the only asset is a home, again, you may not need to open probate. However, you really need to call Jill M. Metz & Associates because this situation could be tricky. This would cost less than opening probate.
Regardless of opening Probate or not, a Will must be filed with the Clerk of the Court within 30 days after death.
- What are the costs to begin a probate case?
- Jill Metz & Associates charges a minimum of $2000.00 for attorney fees. The total attorney fees will depend on your specific issues.
- Cook County Probate Division is currently charging $256.00 to open the file with the court.
- The information for the case must also be published in order to inform the public of the death, currently the cost is approximately $200.00 depending on the publication.
- Bond costs will vary depending on the amount of the estate.
